Licensing Act 2003 - Timescales

  Application Received When Responsible Authorities (RA) must receive a copy Representation Period Deadline for notice of hearing to be sent Date when hearing must take place

Licence issued*

New Personal Licence Day 1 The Licensing Section inform the police that the applicant has an unspent conviction for a relevant offence or foreign offence  14 days beginning with the day the police receive the notice under subsection (4), give the Authority a notice stating the reasons why they are not satisfied (an objection notice)  

10 working days prior to the first day of the hearing, the notice of hearing of the meeting,

to Chief Officer of police and the applicant 

Hearing must be held within 20 working days beginning with the day after the period allowed for the police to give notice 

 3 months granted

Premises Licence - Variation  Day 1 Day 1 - copies of applications and supporting documents to all RA's  28 days beginning the day after the RA's received the application.  Same period for interested parties. 10 working days prior to the first day of the hearing, to any RA's who made a valid representation and any interested parties who made a valid representation Hearing must be held within 20 working days beginning the day after the period allowed for representations  2 months

Club Premises Certificate - New Day 1 Day 1 - copies of applications and supporting documents to all RA's  28 days beginning the day after the RA's receive the application.  Same period for interested parties. 10 working days prior to the first day of the hearing and the notice of the hearing Hearing must be held within 20 working days beginning the day after the period allowed for representations 2 months

 

*within period detailed.  If not issued, then deemed refused.

Notes

  • Variation of a Premises Licence - if not determined within 2 months of receipt of the application deemed refused, right of appeal to Magistrate's Court.
  • Representations may be made by a Responsible Authority or interested party at any time during the period of 28 consecutive days starting the day after the day on which the application was given by the applicant to the Local Authority.
  • If the police wish to make a representation, they must do so within 28 days, both to the Licensing Authority and to the applicant.
  • Hearings for Premises Licences, provisional statements, Variation of Premises Licence, Vary Premises Licence and specify individual as Premises Supervisor, Transfer of Premises Licence, Review of Premises Licence, Club Premises Certificate, Personal Licence - commence 20 working days beginning with the day after the end of the period allowed for representations.
    • Day 1 : Application is made when the Local Authority are in receipt of the completed application, fee and plan
    • Day 2 - 29 : Period for representation from Responsible Authorities or Interested Parties
    • Day 30 : 20 working days from day 30, the hearing must take place for a grant of variation etc
