Abandoned vehicles
Roads, Highways and Pavements
The Council will investigate any vehicles reported as abandoned on public roads and property. The vehicle may be removed if it is causing a public nuisance, is untaxed or if it has not been removed by the owner a specified length of time after a notice of removal has been placed on the vehicle.
A vehicle which is abandoned in accordance with the Road Act 1978 (Amended 8/4/08) must in the opinion of the Waste Collection Authority be only fit for destruction.
All other vehicles are nuisance vehicles and are not waste until the intention of the owner of the vehicle can be established.
Nuisance vehicles can be removed from highway or private land under various pieces of legislation by a number of different agencies including the Police, Fire Service, DVLA, VOSA and Enforcers of parking regulations but only a waste collection authority can remove an ABANDONED VEHICLE under the Road Act 1978.
